In a significant development for healthcare policy, the Centers for Medicare & Medicaid Services (CMS) has announced the implementation of a Medicare hemp coverage program, which will allow eligible Medicare patients to access up to $500 worth of hemp-derived products. The Medicare hemp program primarily focuses on cannabidiol (CBD) products but also permits a limited amount of tetrahydrocannabinol (THC) in these offerings. Specifically, products can contain a maximum delta-9 THC percentage of 0.3% by dry weight and a total of 3 milligrams of THC per serving. This initiative aims to improve access to full-spectrum CBD products, following an executive order signed by former President Donald Trump.
Despite the program’s potential benefits, it has not been without controversy. Individual plaintiff David Evans claims he has standing to oppose the program as a Medicare recipient, yet federal agencies have rejected his assertions. The government maintains that the plaintiffs have not suffered any harm from the Medicare hemp program, stating that Evans himself has expressed opposition to hemp products and will not use them.
In a recent brief, the government argued that the expenditures made by anti-cannabis organizations, such as Smart Approaches to Marijuana (SAM), are part of their organizational missions and not a diversion from them. The brief also emphasized that hemp is not marijuana, countering SAM’s claims that the program undermines its advocacy efforts.
Judge Trevor N. McFadden has already ruled against the plaintiffs, rejecting their request for a temporary restraining order to halt the program’s launch. This decision underscores the government’s confidence in the legality and necessity of the Medicare hemp coverage initiative. CMS clarified that it does not pay for hemp products under the Beneficiary Engagement Incentive (BEI); instead, providers will furnish eligible products at their own cost within a shared-savings framework.
As the launch date approaches, the White House Office of Management and Budget has held meetings regarding a Food and Drug Administration (FDA) enforcement policy on CBD products. The FDA has issued guidance indicating it does not intend to interfere with the Medicare hemp-derived products coverage plan, further solidifying the program’s foundation.
